The Meetup Network Terms of Use

We welcome you to the Meetup Network. The Meetup Network is a public online platform where you publish and promote your meetup and manage them.

  1. Purpose and scope
    1. For the use of The Meetup Network, the following terms of use apply in the relationship between the user ("you", "User") and Sascha Nitsch Unternehmensberatung GmbH as the operator of the site ("We"). Certain provisions of these Terms of Use apply only to users who publish and plan meetups on The Meetup Network ("organizer"). The use of The Meetup Network is only permitted if you accept these Terms of Use.
    2. We reserve the right to amend these Terms and Conditions with effect for the future in a reasonable manner in order to take into account, for example, changes the legal framework conditions or changes in the services offered. In this case we will notify you of the changes. The changes are considered accepted if you don't object to them within four weeks after notification of the changes. With your objection you terminate this contract in accordance with section 6.1.
  2. Registration
    1. Prerequisite for the use of The Meetup Network is a prior registration. Only natural persons over the age of 13 and legal entities may register. There is no right to registration.
    2. The registration requires either the use of a "login with" provider like Content Nation, Google or Apple or an e-mail address and the password of your choice; for organizers additionally the first and last name and the address. Please make sure that your access data (i.e. e-mail address and password) are only used by you. Afterwards you have to Confirm your email address.
    3. You undertake to provide truthful and complete information about all the data you provided during registration. You are not allowed to give your access to unauthorized third parties. You are obliged to keep your access data secret and to protect it from access by unauthorized third parties.
  3. Rights and obligations of the user
    1. The use of The Meetup Network is only permitted within the scope of the intended functions. You must not disrupt or interrupt the operation of The Meetup Network or falsify usage analyzes.
    2. The Meetup Network is subject to copyright protection. It is not permitted to copy, reproduce, or make the platform in whole or in part without our permission. The same applies to the content provided that it is not expressly approved for use.
    3. By providing content, you assure that it is created by yourself and is free of third party rights.
    4. You may not distribute the following content on The Meetup Network:
      • personal attacks, defamatory or derogatory statements about other people, especially insults, discrimination or harassment,
      • Advertising for products and services (including links to third party commercial websites, surreptitious advertising and spam)
      • deliberately factually incorrect or misleading information ("fake news"), unless it is satire,
      • confidential and sensitive information that violates the personal rights of third parties,
      • otherwise illegal or immoral content including gambling, content that serves to incite the public, lead to crime or glorify violence or trivialize, are sexually offensive, are pornographic, are likely to morally endanger children or adolescents or to impair their welfare or damage the reputation of The Meetup Network. This also applies to computer viruses and malware.
    5. Please report technical errors and content that violate these terms of use.
  4. Our rights and obligations
    1. We are entitled to add or remove features or additional or new restrictions for The Meetup Network, taking into account the respective interests, including the right to close The Meetup Network.
    2. We do not check the content of users or third parties, but reserves the right to do so and to block or remove content at our own discretion.
    3. We reserve the right, at our own discretion, to block a user account at any time with immediate effect, even without notice, if the user violates these terms of use
    4. There is no right to take over provided content in The Meetup Network. We are free to edit the provided content and automatically or according to our selection to highlight sections.
  5. Transfer of rights
    1. By posting or making content available on or for The Meetup Network, you grant us, free of charge, the perpetual sublicensable, and non-exclusive rights to publish, make available to the public, and reproduce content necessary for the worldwide operation and promotion of The Meetup Network.
    2. You consent to processing, including translations, the creation of derived works and the integration into other works by the provider or other users.
    3. At the same time, you allow every other user to use the content within the framework of The Meetup Network.
    4. You further guarantee that in the event of the existence of third party rights to the posted content, they have fully and effectively transferred the above rights. You may not post or provide any third party content without the necessary consent or license to use it, for example in the case of copyrighted photos and videos.
  6. Warranty and liability
    1. We do not check the content provided by users or third parties in The Meetup Network and do not guarantee the legality or other quality of the User or third party content. Liability for content posted by users or third parties is excluded.
    2. Liability for damage resulting from the use of this website and its information is excluded, regardless of the legal reason, unless it is for gross negligence or intent on our part, the Product Liability Act, an injury to life, limb or health or an injury of material contractual obligations by us. The essential contractual obligations include such obligations, the violation of which would endanger the purpose of the contract and their fulfillment the contractual partners can therefore trust regularly. In the event of a breach of essential contractual obligations, we are liable for any culpable conduct on the part of our legal representatives and vicarious agents. In the latter case, liability is limited to the typical damage that was reasonably foreseeable for the parties. Our liability for indirect Damage, consequential damage or loss of profit is also excluded to the extent permitted by law.
  7. Termination
    1. You can cancel your registration at any time by giving us an appropriate notice without notice period.
    2. In the event of termination, we are entitled, but not obliged, to delete all or part of the content provided. A claim to the transfer of the created content is excluded.
    3. We are entitled to cancel the registration with two weeks' notice to the end of the month. If there is an important reason, we are entitled to cancel the registration without notice.
  8. Data protection
    1. The data protection declaration applies to the processing of personal data by us.
  9. Final provisions
    1. Place of jurisdiction for all disputes between the contracting parties, insofar as this can be agreed, is Frankfurt am Main, Germany
    2. German law applies exclusively to this contract, excluding international private law and the United Nations Convention on Contracts for the International Sale of Goods.
